H-3 (trainee) visas are issued pursuant to INA §101(a)(15)(H)(iii), 8 U.S.C. §1101(a)(15)(H)(iii); 8 C.F.R. §214.2(h)(7)(i).
Trainee (H-3) visas are issued to temporary worker invited by an individual or organization for purposes of receiving instruction and training other than graduate medical education or training. The training program must be one "that is not designed primarily to provide productive employment..."
