Professionals, Skilled and Other Workers (EB-3)-INA §203(b)(3), 8 U.S.C. §1153(b)(3)
Eligibility
1. Professionals-Baccalaureate degree (or foreign university equivalent) and persons who are members of the professions.
2. Skilled Workers-Full-time permanent job requiring at least 2 years training or work experience. Relevant post-secondary education may be considered as training. 8 C.F.R. §204.5(l)(2).
3. Other Workers-Includes foreign nationals with less than 2 years of training and work experience.
4. Labor Certification is needed for all third preference categories. An NIW is not available for EB-3.
